General Terms and Conditions of Visitors to Bounce Valley
These Terms and Conditions contain important information about your visit and purchases at Bounce Valley.

Article 1. Definitions
The capitalised definitions shall have the following meanings in these General Terms and Conditions:

  1. General Terms and Conditions: these General Terms and Conditions of Visitors.
  2. Visitor: (i) any natural person who enters the buildings and/or premises of Bounce Valley, as well as in the case of a minor, its parent or legal representative and/or (ii) any natural or legal person who in any way directly or indirectly concludes an Agreement with Bounce Valley.
  3. Group: 2 (two) or more Visitors who visit Bounce Valley in an organised manner.
  4. Bounce Valley: Bounce Valley Group B.V. with its registered office and place of business in Houten and registered with the Chamber of Commerce under number 80140971, its affiliated direct and indirect subsidiaries and participations and franchise companies using the Bounce Valley brand.
  5. Agreement: any agreement with Bounce Valley under which Bounce Valley provides services or products to the Visitor.
  6. Entrance Ticket: a ticket granting the Visitor access to any of the Bounce Valley airparks during opening hours.
  7. Website: www.bouncevalley.nl

Article 2. Applicability

  1. These General Terms and Conditions apply to (i) any visit to a Bounce Valley facility and/or (ii) all legal relationships between Bounce Valley and the Visitor, including in any case the Agreement and to all offers and quotations from Bounce Valley.
  2. These Terms and Conditions shall be handed over when an Admission Ticket is booked via Bounce Valley's Website and are also available at the box office of each Bounce Valley establishment. Express or tacit acceptance of these General Terms and Conditions provided when entering into an Agreement or making a reservation constitutes an acceptance of the applicability of the General Terms and Conditions and an agreement with their content.
  3. Deviations from these General Terms and Conditions shall only be valid if expressly agreed in writing and shall only apply to the Agreement in question.
  4. If a provision in these General Terms and Conditions conflicts with the Agreement, the provision in the Agreement shall prevail. In case of conflict between the provisions of these General Terms and Conditions and the information material available to the visitor on the Website and at the branches of Bounce Valley, the provisions of these General Terms and Conditions shall prevail.
  5. The applicability of general terms and conditions or purchasing conditions of the Visitor is expressly rejected by Bounce Valley.

Article 3. Offers, quotations, formation of agreements

  1. All announcements made or otherwise provided by Bounce Valley, such as opening times and rates, are without obligation and subject to change.
  2. Bounce Valley accepts no liability for any errors in any announcements, offers, communications or otherwise provided by Bounce Valley to Visitors, or for errors made in the sale of Admission Tickets by third parties.
  3. An Agreement is established by the Visitor's acceptance of an offer from Bounce Valley, unless there is an Agreement concluded via the website in which case the Agreement is established at the time Bounce Valley has sent the Visitor an e-mail confirmation.
  4. An Admission Ticket may be purchased at the box office of the relevant airpark or reserved in advance via the Website. An Admission Ticket shall become invalid by the mere expiry of the time stated on the Admission Ticket.
  5. An Access Ticket is personal and valid only for the Bounce Valley location for which it has been issued. Offers, quotations and Agreements of Bounce Valley may not be made available for inspection to third parties without its consent. Third parties cannot derive any rights from offers, quotations and Agreements made by Bounce Valley.

Article 4. Access to Bounce Valley airparks

  1. The Visitor shall only be entitled to enter the area of the Bounce Valley park mentioned on the Admission Ticket on presentation of a valid Admission Ticket.
  2. Children aged 0 to 4 years may only visit the Bounce Valley airpark and have access to the air cushions when accompanied by an adult. Children aged 4 to 12 years may only visit the Bounce Valley airpark under adult supervision. Children over 12 years old may visit the airpark without an adult. Groups must be accompanied by at least one adult.
  3. Parents/carers and other supervisors are at all times responsible for and accountable for the behaviour of the minors, individuals or Group(s) they accompany.
  4. Bounce Valley reserves the right to refuse Visitors without giving reasons and it shall not be liable for any damages, whether direct or indirect, arising from such refusal.

Article 5. Obligations of the Visitor

  1. The Visitor is obliged at all times to comply with these General Terms and Conditions, the house rules and safety regulations as made known on the Website, the premises and in the buildings of Bounce Valley and the directions and instructions given by employees of Bounce Valley and/or other third party(ies) engaged by Bounce Valley.
  2. The Visitor must be present at the relevant Bounce Valley facility 15 minutes before the start of the agreed activity. Non-attendance or late attendance by the Visitor or a Group entitles Bounce Valley to mark the Agreement as cancelled in accordance with the provisions of these General Terms and Conditions, unless this is not reasonable in view of the duration of the delay, at Bounce Valley's discretion. In any case, the Visitor or the Group shall not be entitled to an extension of the activity or to catch up with it at another time.
  3. The Visitor is obliged to take note of the house rules and safety regulations as made known on the Website, the premises and in the buildings of Bounce Valley before the start of the activities in the airpark. The Visitor is deemed to be familiar with the house rules and safety regulations before the start of the activities in the airpark.
  4. If in the opinion of (an employee of) Bounce Valley the Visitor in any way violates these General Terms and Conditions, the house rules and safety regulations and/or the (customary) directions and instructions of employees of Bounce Valley and/or other third parties engaged by Bounce Valley, the Visitor can be denied (further) access to the Bounce Valley premises. Bounce Valley is then not obliged to compensate any damage and/or to refund the amount paid by the Visitor for his/her Entrance Ticket, whether or not through a third party.
  5. If the Visitor repeatedly does not, does not fully or does not immediately comply with or violate provisions in the General Terms and Conditions, the house rules and safety regulations and/or directions and instruction given by employees and/or other third party(ies) engaged by Bounce Valley, Bounce Valley can deny the Visitor access to the Bounce Valley establishment(s) for a certain period of time.
  6. Participation in activities at the airpark is only permitted for Visitors who are in good health. The Visitor declares that, to the best of his/her knowledge, he/she is healthy and in good physical condition, and that there is no other obstacle to safe participation in the activities at the airpark (e.g. a psychological/mental condition or pregnancy that could prevent safe participation in the activities at the airpark). If in doubt about participating in the activities, it is the Visitor's responsibility to refrain from doing so.
  7. The Visitor is not allowed to participate in activities at the airpark under the influence of drink, drugs or medication.
  8. The Visitor is not permitted to bring his/her own food or drink and consume it on the premises of Bounce Valley.
  9. The Visitor is not permitted to bring pets or other animals to, or within the facilities of, Bounce Valley, with the exception of legally recognised assistance animals (such as guide dogs for the blind), provided prior written permission has been granted by Bounce Valley.
  10. In the event of vandalism, damage, removal, misappropriation or theft of items by the Visitor, Bounce Valley shall be entitled to (a) deny the Visitor access to the premises, (b) impose a ban on the Visitor's access to one or more premises for a definite period of time, (c) report the matter to the police, (d) hold the Visitor liable for damages suffered, including but not limited to losses suffered and lost profits.

Article 6 Reservation of Tickets

  1. Entry tickets can be reserved in advance in person at the counter of or by telephone at a Bounce Valley establishment or in writing via the Website. A reservation via the Website shall be deemed to have been made if the Visitor has completed the reservation form and sent it electronically to Bounce Valley by clicking on the confirmation button on the Website. Bounce Valley may attach further conditions to a reservation. The Agreement comes into effect with the acceptance of an offer from Bounce Valley.
  2. Payment for services or products ordered shall be made via one of the payment options offered from time to time by Bounce Valley.
  3. In accordance with Article 6:230p sub e of the Civil Code, the right of withdrawal does not apply to Agreements for the provision of services relating to leisure activities, if the Agreement provides for a specific time or period of performance and the Visitor has no right to rescind the Agreement. In all other cases, the Visitor has the right to rescind an Agreement established through the Website for 14 days after receiving the e-mail confirmation from Bounce Valley.

Article 7. Payment

  1. Bounce Valley does not provide products or services on account. Payment shall be made no later than prior to the Visitor entering the relevant premises of Bounce Valley.
  2. The Visitor must check the invoice or receipt and any cash refund immediately upon checkout for accuracy. If the Visitor does not complain immediately, Bounce Valley is not obliged to deal with the complaint at a later date. Any right of claim of the Visitor will lapse if no direct complaint is made and no legal action is taken within one year of the complaint.
  3. In all cases, where the parties have agreed on a form of payment other than cash payment, payment by the Visitor of the amounts due to Bounce Valley must be made within 14 days of the invoice date to the bank account stated on the invoice but no later than prior to the Visitor's entry to the relevant premises of Bounce Valley. Visitor shall not be entitled to any set-off, deduction or suspension.
  4. If a Visitor has not paid within the period specified in Article 7(3), Visitor is immediately in default and, without further notice of default and without prejudice to its other rights, Bounce Valley is entitled to charge statutory interest from the due date of the invoice and the Client is obliged to reimburse the judicial and extrajudicial (collection) costs actually incurred by Bounce Valley. If the Visitor is a consumer, extrajudicial collection costs will be charged according to the Besluit Vergoeding voor Buitengerechtelijke Incassokosten.
  5. Bounce Valley shall never be obliged to refund an unused Entrance Ticket.

Article 8 Cancellation

  1. The following rules shall apply to cancellation of an Agreement:
  2. for cancellation up to 48 hours before the day of the reserved activity, the Visitor is bound to pay 50% of the principal sum of the Agreement; and
  3. in the event of cancellation less than 48 hours before the day of the reserved activity, the Visitor is bound to pay the full principal sum of the Agreement.
  4. Any amounts to be refunded by Bounce Valley under clause 8.1(a) will be refunded by Bounce Valley to the relevant Visitor within 14 days of the day of the reserved activity.

Article 9. Liability of Bounce Valley

  1. Entering the buildings and grounds of Bounce Valley and participating in activities at the airpark is at the expense and risk of the Visitor. The Visitor understands and accepts that entering the buildings and grounds of Bounce Valley participation in the activities at the airpark involves risks to health and may result in damage to property and serious physical injury.
  2. Bounce Valley shall not be liable for damages of the Visitor of any kind unless the Visitor's damages are the direct result of gross negligence or wilful misconduct by Bounce Valley.
  3. Bounce Valley shall not be liable for any consequential damage, trading loss or indirect damage of the Visitor resulting from Bounce Valley's failure to fulfil the Agreement, or failure to fulfil it on time or properly.
  4. Except in cases of intent and/or gross negligence, Bounce Valley is not liable for theft, loss, damage and/or loss of goods of the Visitor, including in the event that lockers of Bounce Valley are used. The Visitor indemnifies Bounce Valley from any claim in this respect.
  5. Bounce Valley shall not be liable for any damages incurred by the Visitor as a result of any acts or omissions of third parties engaged by it to carry out the Order.
  6. Bounce Valley's liability shall at all times be limited to the sum of the Agreement and in any case limited to the amount paid out by Bounce Valley's liability insurance in the relevant case.
  7. Rights of claim of the Visitor on any grounds whatsoever against Bounce Valley in connection with a visit to Bounce Valley will in any case lapse if the Visitor has not taken legal action against Bounce Valley without delay or, if this is not reasonably possible, at the latest within 7 days of the time when the Visitor became aware or could reasonably have become aware of the existence of these rights.
  8. The Visitor is liable for all damages incurred by Bounce Valley in connection with a shortcoming and/or unlawful act (including violating the house rules and safety regulations and/or not following reasonable instructions from employees of Bounce Valley or third party(ies) engaged by Bounce Valley) of the Visitor or visitors accompanying the Visitor or visiting Bounce Valley under the Visitor's supervision.

Article 10. Complaints procedure

  1. In case of complaints, the Visitor is obliged to report his/her complaint to the branch manager of the relevant Bounce Valley branch without delay, or if this is not reasonably possible, at the latest within 7 days after leaving the Bounce Valley branch.
  2. Following the complaint, the Visitor and the Bounce Valley branch manager will try to find a solution to the complaint by mutual agreement. If the parties fail to do so, the Visitor may submit the complaint to the Bounce Valley management within 14 days of his/her visit to Bounce Valley.

Article 11. Force majeure

  1. Bounce Valley is not obliged to comply with any obligation under the Agreement if and as long as Bounce Valley is prevented from doing so by a circumstance that cannot be attributed to Bounce Valley by virtue of law, legal act or according to socially accepted standards. Force majeure for Bounce Valley also includes: work strikes within Bounce Valley's company and special circumstances or calamities that make fulfilment of the Agreement impossible or irresponsible (including technical faults).
  2. Damage suffered by the Visitor as a result of force majeure other than restitution of or remission of the price of the part of the Agreement affected by force majeure shall never be eligible for compensation.

Article 12. Other provisions

  1. Changes to the Agreement shall be effective only after they have been set out in writing by Bounce Valley and confirmed in writing by the Visitor.
  2. The applicability of these General Terms and Conditions does not affect the possible applicability of other (contractual) terms and conditions and/or regulations of Bounce Valley.
  3. If any provision of these General Terms and Conditions or the Agreement should be wholly or partly void and/or invalid and/or unenforceable as a result of any statutory regulation, court ruling or otherwise, this will have no effect on the validity of all other provisions of these General Terms and Conditions or the relevant Agreement.
  4. Without prejudice to the provisions of Article 14(3), the parties shall consult in order to agree on new provisions to replace the void or voided provisions. The purpose and purport of the null and/or voided provisions shall be approximated as much as possible.
  5. Bounce Valley reserves the right to modify these Terms and Conditions.
  6. These General Terms and Conditions and the Agreement are exclusively governed by Dutch law.
  7. All disputes will be settled by the competent court in the Netherlands.
